Call recording

One-party and two-party consent states, and the interstate trap.

Calls on LeadBind are recorded and stored in your account. Whether you need to say so out loud depends on your state.

One-party and two-party states

One-party consent is the majority rule. One person on the call needs to know it is being recorded. Since your side knows, you are generally covered.

Two-party consent (also called all-party consent) means everyone on the call must agree. California, Florida, Illinois, Pennsylvania, Washington, and several others work this way. In those states, recording without telling the other person can be a crime, not just a lawsuit.

The trap is interstate calls. If you are in a one-party state and you call someone in a two-party state, the safe assumption is that the stricter rule applies. Do not talk yourself into the lenient one because your own state is easy.

What this means in practice

If you only ever call inside a one-party state, you are probably fine without a spoken notice, and you should still consider giving one.

If you call anywhere else, or you do not know where your leads are, put a recording notice in your opening. It is one clause and it costs you nothing.

Add it in your script. Something like: this call is recorded for quality. Put it near the top, next to the AI disclosure, and move on.

Note: The AI disclosure is automatic and not configurable. The recording notice is yours to add, because only you know where you call.

What LeadBind does

  • Records and stores calls in your account so you can listen to them.
  • Keeps them inside LeadBind. Recordings and transcripts are not available through the API, the CLI, or a connected AI assistant, at any permission level, and there is no setting that changes that.

That second one is deliberate. Your customer consented to you recording, under whatever disclosure you gave them. They did not consent to a third-party AI vendor holding their words. Handing that out quietly would be trading your legal exposure for our convenience. See What we send.

Who is on the hook

You are. You are the party to the call, you chose to record, and you chose who to dial. LeadBind provides the recording; the disclosure obligation is yours.

Practically:

  • Add a recording notice to your script if you call across state lines
  • Do not share a recording with someone who was not on the call, unless you are certain you may
  • If someone asks you to delete a recording of them, take it seriously
